APPLY FOR A CANNABIS LICENCE

The Cannabis Licensing Authority (CLA), an agency of the Ministry of Industry, Commerce, Agriculture and Fisheries (MICAF), was established under the Dangerous Drug Amendment Act (DDA), with a specific role to establish and regulate Jamaica’s legal ganja and hemp industry.

The Authority’s Licensing and Applications Division (LAD), as well as, its Enforcement and Monitoring Division (EMD), work together to ensure that applications are appropriately reviewed, and licenses issued to qualified applicants; and that licensees comply with the terms and conditions of their license.

Any person or organisation meeting the criteria set by the relevant legislation and regulations can apply for a licence for the use, cultivation, processing, transportation, importation, exportation, transit, manufacture, sale, possession and distribution of Cannabis for medical, therapeutic or scientific purposes (including research, clinical trials, therapy and treatment and the manufacture of nutraceuticals and pharmaceuticals).

Process Quick Tips
  1. The Authority does not accept applications from International Business Corporations (IBC). Likewise, if an applicant’s shareholder is an IBC, that application will not be accepted by the Authority.
  2. If the property to be licensed is within a declared historic area/zone approval must be sought from the Development Review of the Jamaica National Heritage Trust for the restoration or development of declared/preserved sites or the erection of a new building. The Authority is to be satisfied that approving the application would not be inconsistent with any requirements of the Jamaica National Heritage Trust.

  1. Breaches: Where there is a breach in the terms and conditions the CLA may:
    • Suspend a licence
    • Revoke a licence
    • Prevent a licensee from re-applying for a specified period
    • Forfeit the licensee’s security
    • Other appropriate action determined by the CLA
  1. Transportation Policy: All transportation vehicles must meet the general “Post -Licence Transportation Requirements“ of the CLA. Other specific requirements shall be determined and met when it has been determined by a licensee or by regulatory standards that certain conditions are required for conveying certain ganja plants, ganja products, or other ganja commodities.
